Liability Release and Waiver Agreement

This Liability Release and Waiver Agreement (the "Agreement") is made between Glow Girl Spray Tanning, hereinafter referred to as "Glow Girl," and the individual or legal guardian (the "Client") using Glow Girl’s services through its partnership with Greensboro Allstar Cheerleading (the "Cheer Gym"). By booking a tanning appointment, the Client agrees to the terms and conditions outlined in this Agreement.

1. Assumption of Risk and General Release
The Client acknowledges and understands that the spray tanning services provided by Glow Girl involve the application of tanning solutions, which may result in allergic reactions, skin irritation, or other reactions. The Client hereby voluntarily assumes all risks associated with receiving a spray tan, including, but not limited to, any skin conditions, allergic reactions, or other health concerns that may arise from the use of the Norvell Professional Solutions products, which are used exclusively by Glow Girl for tanning services.

2. Liability Waiver
The Client, on behalf of themselves and any minors under their care, releases, waives, and discharges Glow Girl, its employees, contractors, agents, and affiliates, as well as the Cheer Gym, its owners, employees, and agents, from any and all claims, actions, liabilities, or demands that may arise from participation in the spray tanning services, whether such claims are for personal injury, property damage, or any other cause.

3. Minors and Parental Consent
For any individual under the age of 16, a parent or legal guardian must be present during the spray tanning appointment. By booking an appointment for a minor, the parent or guardian acknowledges that they are responsible for ensuring the minor’s safety and comfort during the session. Additionally, by signing this Agreement, the parent or guardian consents to the minor receiving spray tanning services and waives any rights to claim liability against Glow Girl or the Cheer Gym in the event of any injury or adverse reaction.

4. Parent or Guardian Responsibility for Minors
If the Client is a parent or guardian of a minor receiving services, the parent or guardian agrees to be fully responsible for the actions, behavior, and well-being of the minor while at the appointment. The parent or guardian understands that they are required to be present at the time of the tanning session for any individual under 16 years of age.

5. No Liability for Personal Property
Glow Girl and the Cheer Gym are not responsible for any personal belongings that are brought to the tanning appointment. This includes, but is not limited to, any personal items such as clothing, accessories, bags, or electronic devices. Glow Girl is not liable for any damage, theft, or loss of such items during or after the tanning session.

6. Third-Party Responsibility for Products
Glow Girl uses Norvell Professional Solutions tanning products in all spray tanning services. Norvell is solely responsible for the formulation, ingredients, and safety of its products. The Client acknowledges that any concerns or complaints regarding the Norvell products should be directed to Norvell and not to Glow Girl or the Cheer Gym.

7. Scheduling and Cancellations
The Client agrees to schedule appointments at their own convenience. In the event of cancellations or changes to appointments, the Client agrees to adhere to Glow Girl's cancellation policy as provided on the website or at the time of booking. The Client also acknowledges that the Cheer Gym is not responsible for any scheduling conflicts, changes, or cancellations of appointments.

8. No Litigation Against Glow Girl or Cheer Gym
The Client agrees that they will not initiate, join, or participate in any legal action or lawsuit against Glow Girl or the Cheer Gym for any cause arising out of or related to the spray tanning services, including but not limited to any claims for personal injury, allergic reactions, or damages resulting from the tanning process.

9. Website Agreement and Acceptance
By booking an appointment through the Glow Girl website or participating in this partnership, the Client agrees to accept and abide by the terms of this Agreement. The Client further acknowledges that their acceptance of this Agreement through the website serves as their electronic signature, binding them to all provisions stated herein.

10. Governing Law and Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of the state in which Glow Girl operates. Any disputes arising under or in connection with this Agreement shall be resolved in the courts of that jurisdiction.

I, the undersigned, confirm that I have read, understood, and voluntarily agree to the terms and conditions set forth in this Liability Release and Waiver Agreement. I understand that by booking a tanning appointment or consenting to my minor's participation, I am waiving certain legal rights, including the right to sue for any injuries or damages.

No signatures are required to uphold this policy. The terms must be agreed to be the subscriber before scheduling an appointment.
